Service Obligations:
Service Provision: RetireEase provides elderly care services to clients, including assistance with daily activities, medical care, and emotional support, subject to agreement amendments.
Service Updates: RetireEase may update or modify services during the term to enhance client care and ensure compliance with best practices.
Client Support: RetireEase offers client support via phone and email during standard business hours to address inquiries and provide assistance.
Client Feedback:
Client feedback regarding services, including suggestions for improvements or modifications, will be considered by RetireEase to enhance the quality of care provided.
Survival:
Upon termination, certain provisions related to fees, confidentiality, and client responsibilities will survive to ensure continuity of care and financial obligations.
Confidential Information:
Confidentiality: RetireEase will maintain the confidentiality of client information, including medical records and personal data, in compliance with applicable privacy laws.
Data Protection: Client data, including medical records and personal information, will be securely stored and processed only for the purpose of providing care services.
Representations and Disclaimers:
Service Quality: RetireEase represents that it will provide elderly care services with professionalism, compassion, and adherence to industry standards.
No Guarantees: While RetireEase strives to deliver high-quality care, it does not guarantee specific outcomes and disclaims liability for unforeseen events or circumstances.
Indemnification:
Client Indemnification: Clients agree to indemnify and hold RetireEase harmless from any claims arising from client actions or decisions related to care services.
RetireEase Indemnification: RetireEase agrees to indemnify clients against claims arising from negligence or misconduct on the part of RetireEase staff or contractors.
General:
Governing Law: The Agreement is governed by state laws, and any disputes will be resolved in the specified courts.
Notices: All notices must be in writing and delivered to the specified addresses of the parties.
Force Majeure: Neither party is liable for failure to perform obligations due to circumstances beyond their control, including natural disasters or emergencies.
No Partnership: The Agreement does not create a partnership or agency relationship between RetireEase and the client.
Entire Agreement: The Agreement constitutes the entire understanding between the parties regarding elderly care services and supersedes any prior agreements or understandings.
